Welcome to The Unusual Space - Shop.

Throughout these Terms of Service, the terms "The Unusual Space - Shop", "we", "us", and "our" refer to The Unusual Space - Shop, the operator of this webshop and the provider of the products and services available through it.

Our webshop is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services to you. Unless explicitly stated otherwise, all purchases made through this webshop are concluded directly between you and The Unusual Space - Shop.

These Terms of Service ("Terms") govern your access to and use of our website, webshop, products, content, digital features and any related services (collectively, the "Services").

ARTICLE 1 – ACCESS TO THE SERVICES AND CUSTOMER ACCOUNT

If you create an account on our webshop, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate, complete and up-to-date information whenever you register an account, place an order or otherwise communicate with us. You are responsible for updating your account information whenever necessary.

You may not transfer, sell, share or otherwise allow another person to use your customer account without our prior written consent.

We reserve the right to suspend or terminate an account where fraudulent activity, misuse of the Services, or violations of these Terms are reasonably suspected.

ARTICLE 2 – PRODUCTS AND PRODUCT INFORMATION

We make every reasonable effort to ensure that all product descriptions, specifications, photographs and prices published on our webshop are accurate and up to date.

However, colours, materials and product appearance may differ slightly depending on your device, display settings or browser configuration.

All products are offered subject to availability.

We reserve the right to modify product information, discontinue products or update pricing without prior notice where reasonably necessary.

Obvious typographical errors, pricing mistakes or inaccuracies in product descriptions do not constitute a binding offer and may be corrected at any time before an order has been accepted.

Nothing in these Terms affects your statutory rights as a consumer under applicable Dutch or European consumer protection legislation.

ARTICLE 3 – ORDERS AND PURCHASE AGREEMENTS

By placing an order through our webshop, you submit an offer to purchase the selected products.

A purchase agreement is concluded only after your order has been accepted by us and a confirmation has been sent to the email address provided during checkout.

We reserve the right to refuse or cancel an order where there are reasonable grounds to believe that:

  • fraudulent activity has occurred;

  • incorrect pricing or technical errors affected the order;

  • products are unavailable;

  • the order appears intended for unauthorized commercial resale;

  • compliance with applicable laws requires us to refuse the order.

Where reasonably possible, we will notify you using the contact details provided during checkout.

Consumers residing within the European Union may exercise their statutory right of withdrawal within fourteen (14) days after receiving their order, unless one of the statutory exceptions applies. ARTICLE 4 – PRICES, PAYMENTS AND BILLING

Unless explicitly stated otherwise, all prices displayed on our webshop include applicable VAT but exclude shipping costs and any additional charges that may apply to your order.

Shipping costs and any additional fees will be clearly displayed before you complete your purchase.

Payment must be successfully authorised before an order can be processed and shipped.

You agree to provide accurate billing, payment and contact information for every order placed through our webshop.

Where payment cannot be authorised or is suspected to be fraudulent, we reserve the right to refuse or cancel the order.

Invoices, where applicable, will be issued in accordance with Dutch tax legislation.

We reserve the right to correct pricing errors before an order has been accepted. Where a manifest pricing error has occurred, we may cancel the affected order and refund any payments already received.

ARTICLE 5 – SHIPPING AND DELIVERY

We aim to dispatch and deliver all orders within the estimated delivery time indicated during checkout. Delivery times are estimates only and should not be interpreted as guaranteed delivery dates.

Delivery may be affected by circumstances beyond our reasonable control, including carrier delays, customs procedures, public holidays, weather conditions, or other unforeseen events.

Ownership of the products transfers to you once full payment has been received. However, in accordance with applicable European consumer legislation, the risk of loss or damage passes to you only when the products have been physically delivered to you or to a third party designated by you, other than the carrier.

If your order arrives damaged or incomplete, please contact us as soon as reasonably possible so that we can investigate and provide an appropriate solution.

ARTICLE 6 – INTELLECTUAL PROPERTY

All intellectual property rights relating to the Services, including but not limited to our website, product photography, graphics, logos, trademarks, product descriptions, texts, layouts, designs, branding, software, and other content, remain the exclusive property of The Unusual Space - Shop or its licensors.

Nothing contained in these Terms transfers any intellectual property rights to you.

You may access and use our Services solely for your personal, non-commercial use.

You may not reproduce, copy, distribute, modify, publish, sell, exploit or otherwise use any part of our Services without our prior written permission.

Our webshop is operated using the Shopify e-commerce platform.

Although Shopify provides the technical infrastructure through which we operate our webshop, every purchase made through this website is concluded directly between you and The Unusual Space - Shop.

Shopify is not the seller of the products offered through this webshop and is not responsible for product quality, warranties, returns, customer support or contractual obligations arising from purchases unless required by applicable law.
